Terms and Conditions
This contract is addressed to all users who use the platform and/or website owned by AGENCIA DE VIAJES MORALES for the acquisition of products and/or services offered by the latter, and in compliance with the provisions of articles 85, 86, 88, 89 and 90 of the FEDERAL CONSUMER LAW, as well as the provisions of article 53 of the GENERAL TOURISM LAW.
MORALES TRAVEL AGENCY will be solely responsible for fulfilling the previously established services according to its own specifications and will serve only as an intermediary with third-party companies providing accommodation, food, air or ground transportation, or any other type of service in the industry.
By registering and accepting the terms and conditions of AGENCIA DE VIAJES MORALES, Users unreservedly accept the system and are bound by the terms and conditions as if they had signed a legally binding written contract, as set forth herein.
1. MODIFICATION OF TERMS
AGENCIA DE VIAJES MORALES shall have the right at any time to change or modify the terms and conditions applicable to the User's use of the platform AND/OR website owned by AGENCIAS DE VIAJES MORALES or any part thereof, or to impose new conditions, including, but not limited to. Such changes, modifications, additions or deletions shall become effective immediately upon being made known or notified, which notification may be made by various means, including, but not limited to, publication on (agenciadeviajesmorales.com) or by conventional or electronic mail or by any other means that allows users to receive the notification.
Any use of the platform and/or website owned by AGENCIAS DE VIAJES MORALES, as well as of this medium to carry out purposes to which the user has hereby agreed, after such notification will be considered as acceptance by the user of said changes, modifications or additions.
2. GENERAL CONDITIONS OF SUPPLIERS
2.1. AGENCIA DE VIAJES MORALES explicitly states that it is not responsible for the services provided by hotels, air or land transportation, cruises, and other services contracted by users, since it only acts as an intermediary in their contracting, and therefore such responsibility for the provision of these services is transferred to the suppliers.
2.2. Responsibility for services that include transfers and/or land or air transportation with respect to changes in itineraries, delays in departures, overbooking, cancellations and all situations that arise with respect to said transportation will be the sole responsibility of the provider, so the provision of said service must be governed by the terms and conditions expressed by the transportation providers, transferring from this moment AGENCIA DE VIAJES MORALES the responsibility to each provider or service provider.
2.3. In the event of overbooking by the airline, the conditions established by each airline in accordance with the air transport contract will apply, and in the event that hotels are overbooked, the provisions of the General Tourism Law will apply.
2.4. Children over 5 years old will be considered adults and will therefore be charged the same rate and occupy the space as if they were adults.
2.5. Check-in time for hotels, cabins, and lodging facilities will be from 15:00 p.m. and check-out time will be 12:00 p.m.
2.6. PETS: Some establishments prohibit the entry of pets. Therefore, to obtain information on the acceptance of pets, you must first consult AGENCIA DE VIAJES MORALES. AGENCIA DE VIAJES MORALES is not responsible if you are prohibited from entering with pets if you have not previously requested this information.
2.7. If you book cabin accommodations, you will be required to pay a security deposit of $500.00 for small cabins and $1,000.00 for family-sized cabins, in cash. For mountain hotels, the deposit may be between $1,000.00 and $2,000.00 pesos, which may be paid in cash and/or by credit or debit card. These deposits will be returned to the reservation holder at the end of their stay and the lodge has approved that no damage or defects were reported.
3. GENERAL RESERVATION POLICIES
3.1. All package rates published on the AGENCIA DE VIAJES MORALES platform and/or website include air taxes for the purchase of airline tickets from each airline.
3.2. The rates displayed on the website and/or web page owned by AGENCIA DE VIAJES MORALES will be honored for users only if the purchase of the product and/or service is correctly reserved and the corresponding payment is made within 24 hours of booking.
In the event that payment for the service and/or product indicated in the previous paragraph is made by debit or credit card, this will be credited as a successful payment to obtain the published and contracted rate for the service and/or product until it is reflected in the bank account owned by AGENCIA DE VIAJES MORALES and in the event that said payment is rejected by the issuing bank, the reservation and the contracted rate cannot be confirmed or guaranteed by AGENCIA DE VIAJES MORALES.
3.3. The travel insurance included in all our packages, cruises, circuits, and tours is valid only for passengers with Mexican nationality and for the dates on which the trip operates. It covers medical assistance at the destination and reimburses a percentage of your trip, provided it has been issued 15 days before the trip begins.
3.4. The user must register the data requested by the platform and/or website owned by AGENCIA DE VIAJES MORALES to successfully make their reservation. Therefore, the user will be solely responsible for any errors in registering said data.
3.5. It is the user's responsibility to carry all necessary valid documentation requested by the airlines, land travel agencies, the city to be visited and/or the destination country. AGENCIA DE VIAJES MORALES shall not be held responsible for any of the aforementioned entities denying the user entry at their discretion.
3.6. AGENCIA DE VIAJES MORALES will send via email to the person indicated by the user at the time of purchasing the product and/or service, or where appropriate in person, all entry passes for the hotel and/or flights and/or transfers and/or tours and/or circuits and/or vehicle rental and/or cabin rental and/or vacation house rental and/or apartment rental, only in the event that the user has fully paid the agreed price at the time of contracting the product, package and/or service, all rates indicated and/or quoted in dollars and euros must be paid in Mexican pesos according to the exchange rate on the day of payment.
3.7. All government taxes charged by the destination cities and/or countries of the contracted package, product and/or service must be fully covered by the passenger users directly at the destination. AGENCIA DE VIAJES MORALES is not responsible for informing users of said taxes at the time of contracting.
3.8 Rates quoted in dollars and euros must be paid in Mexican pesos according to the daily exchange rate.
3.9. In the event that the user, at the time of enjoying the service, package and/or product contracted on the AGENCIA DE VIAJES MORALES website, arrives at the agreed place to take the tour service or any transfer and the provider does not arrive at said meeting point, he/she must immediately contact AGENCIA DE VIAJES MORALES so that an advisor can assist him/her with alternatives. Otherwise, AGENCIA DE VIAJES MORALES will not be responsible for providing a bonus for said service.
3.9.1. All published promotions are subject to change and space may be lost without prior notice if not reserved. Once reserved and the required amount paid, the rate will be confirmed and guaranteed unchanged.
3.9.2. All lodging reservations may have the following minimum night reservation conditions for the dates indicated below:
a) HIGH SEASON (SUMMER, BRIDGES AND HOLIDAYS): a minimum stay of 2 (Two) nights must be reserved.
b) RACK SEASON (CHRISTMAS, NEW YEAR, EASTER AND EASTER): a minimum of 3 nights must be booked.
c) LOW SEASON: (REST OF THE YEAR): you can book from 1 night.
4. POLICIES FOR CHANGES AND CANCELLATIONS
4.1. Plane and/or bus tickets are non-refundable under any circumstances. Therefore, if the passenger does not show up on the scheduled day and time, they will be charged a penalty of 100% of the purchase price.
4.2.- In the event that the user does not show up on the day and time scheduled to take the contracted services, whether hotels, cruises, tours, etc. AGENCIA DE VIAJES MORALES will not refund any amount to the user.
4.3. All packages, services, and/or products published and purchased through the platform and/or website owned by AGENCIA DE VIAJES MORALES are non-refundable from the moment of purchase.
4.4. Changes to the date and/or destination may be made by the user, with an additional cost that will be indicated by AGENCIA DE VIAJES MORALES. Said change may only be made twenty-five days in advance of the contracted and to-be-contracted travel date, otherwise it will adhere to the policies indicated by the hotel, airline and/or supplier, with the exception of trips or packages in which the legend of NON-REFUNDABLE is indicated in the advertising, platform and/or website owned by AGENCIA DE VIAJES MORALES, for these, changes and/or cancellations will not be accepted. For those services contracted in the season called HIGH OR RACK, that is, in SUMMER, BRIDGES, HOLIDAYS, CHRISTMAS, NEW YEAR'S EVE AND EASTER, changes or cancellations are not allowed, so the user client will lose the total of their advance payment and/or total payment, if applicable.
4.5. All data entered by users cannot be modified through the platform and/or website once the reservation has been successfully paid. Therefore, to make name changes, users must contact the AGENCIA DE VIAJES MORALES reservations department. Users are obligated to cover any additional costs incurred due to the name change.
4.6. All airline tickets are non-refundable from the time of purchase, and those purchased with the economy class fare cannot be exchanged.
